Welcome to www.gocaddy.golf (the “Website”). These Terms and Conditions (“Terms”) govern your access to and use of our Website, as well as the purchase of any products (including but not limited to the GoCaddy personal golf cart, accessories, and related merchandise) from GoCaddy (“we,” “us,” or “our”) through our Website or our physical retail stores.

By accessing the Website, placing an order, or making a purchase in-store, you agree to be bound by these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree to these Terms, you must not use our Website or purchase our products.

1. Definitions

  • “Consumer” means any individual who purchases goods for personal, domestic, or household use and not for commercial resale.
  • “Products” means the goods offered for sale by GoCaddy, including the GoCaddy personal golf cart and related accessories.
  • “Order” means a request by you to purchase Products from us.
  • “Contract” means the agreement formed between you and GoCaddy upon our acceptance of your Order.

2. Eligibility and Account Registration

To place an Order, you must be at least the age of majority in your jurisdiction. You agree to provide accurate, current, and complete information during the registration or checkout process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or cancel Orders at our sole discretion.

3. Products and Availability

All descriptions, images, and specifications of Products on our Website are for informational purposes only. While we strive to be accurate, we do not warrant that descriptions, colours, or other content are error-free. Product availability is subject to change without notice. In the event a Product is listed at an incorrect price or is unavailable, we reserve the right to cancel your Order and issue a full refund.

Manufacturer Warranties: Many of our Products, including the GoCaddy cart, may be subject to manufacturer warranties. Such warranties are provided by the original manufacturer. We will pass through any applicable manufacturer warranties to you. A limited one-year warranty against defects in workmanship and materials under normal use may apply to certain goods. To the extent permitted by law, no other express or implied warranty is provided for any goods supplied. Please check prior to purchase, as the item may have a seperate and more comprehensive warranty.

4. Ordering and Pricing (Online and In-Store)

4.1 Online Orders

By placing an Order on our Website, you make an offer to purchase the Products. We will send you an email acknowledging receipt of your Order; however, this does not constitute acceptance. Our acceptance of your Order occurs when we dispatch the Products or send you a confirmation of dispatch. All prices are displayed in the applicable currency and are exclusive of shipping, handling, and applicable taxes (including GST or sales tax) unless stated otherwise.

4.2 In-Store Purchases

For purchases made at our physical retail locations, the Contract is formed at the point of sale. In-store prices may vary from online prices. All in-store payments are subject to the same refund, return, and warranty conditions outlined in these Terms.

4.3 Payment Terms

We generally require prepayment of all online invoices via credit card (Visa or MasterCard), electronic funds transfer, or other accepted payment methods at checkout. For in-store purchases, we accept cash, credit cards, and other designated payment methods. No goods will be dispatched for online orders until cleared funds have been received. For any approved credit accounts (if applicable), the due date for payment is strictly 7 days following the invoice date. Late payments may result in interest charges and suspension of credit facilities. All goods remain the property of GoCaddy until full payment is received.

5. Shipping, Delivery, and Risk

5.1 Despatch

Our commitment is to ship goods within 3 working days of receiving your completed order, though goods are generally shipped within 9 hours. Orders clearly marked as urgent will be dispatched as soon as practical. Freight charges are based on the value of your order, your location, and the shipping method selected, and will be calculated at checkout. Out of stock item; we will communicate with you if this occurs and a full refund will be given if you have paid in full.

5.2 International Shipping

For overseas sales, please contact us at sales@gocaddy.golf for a specific freight quote.

5.3 Risk and Title

Risk of loss or damage to the Products passes to you upon delivery. Title to the Products passes to you upon our receipt of full payment.

6. Refunds, Returns, and Exchanges

We want you to be satisfied with your purchase. This policy applies to both online and in-store purchases.

6.1 General Returns

Merchandise will only be accepted for return if it is in its original condition (including all packaging, manuals, and accessories) and is returned within 7 days of original shipment or in-store purchase. Custom-made or specially ordered products will not be accepted for return unless faulty.

6.2 Online Returns Process

To initiate a return for an online purchase, you must contact us to obtain a “Return Approval Number” and include it with all goods returned. Credits will be issued for goods accepted for return, less any freight costs incurred in forwarding and returning the goods.

6.3 In-Store Returns

For in-store purchases, you must present proof of purchase (receipt) to the store. You may choose an exchange or refund if the item you purchased has a major problem, such as a fault in function or design. GoCaddy is not obliged to provide an exchange or refund if you simply change your mind about your purchase.

6.4 Damaged or Faulty Goods

All claims for damaged goods must be notified to us in writing within 7 days of delivery. If a Product is deemed faulty under the manufacturer’s warranty, we will facilitate the warranty claim in accordance with the manufacturer’s terms.

7. Acceptable Use of the Website

You agree not to use the Website for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Website. Prohibited activities include, but are not limited to:

  • Excessive spamming, including in comment sections.
  • Using bots or malware to infect the Website.
  • Posting defamatory, obscene, or offensive content.
  • Engaging in aggressive behaviour or language towards our staff or other users.
  • Any illegal activities.
    We reserve the right to terminate your access to the Website or ban you from making future purchases if you violate these rules.

8. Intellectual Property

All content on the Website, including text, graphics, logos, images, and software, is the property of GoCaddy or its content suppliers and is protected by international copyright and trademark laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by law, GoCaddy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • Your use or inability to use the Website or Products.
  • Any unauthorised access to or use of our servers and/or any personal information stored therein.
  • Any interruption or cessation of transmission to or from the Website.

Our total liability to you for any claim arising out of or relating to these Terms or the purchase of Products shall not exceed the amount you paid to us for the Product giving rise to the claim.

10. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia without regard to its conflict of law principles. Any dispute arising from these Terms or your purchase shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

11. Changes to These Terms

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Website or making a purchase after any such changes constitutes your acceptance of the new Terms.
